By accessing or using ZIVR ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including browsers, customers, and contributors of content.
2. Description of Service
ZIVR provides an AI-assisted cold calling tool that helps sales professionals handle objections, generate leads, and improve sales performance. Features include: • AI response generation for sales objection handling • Lead generation via Google Places integration • Multi-language support (English, French, Spanish) • Usage analytics and account management
3. User Accounts
To access ZIVR's features, you must create an account. You agree to: • Provide accurate and complete information during registration • Maintain the security of your password • Notify us immediately of any unauthorized account access • Accept responsibility for all activities under your account We reserve the right to terminate accounts that violate these terms.
4. Subscription and Payment
ZIVR offers free and paid subscription plans. For paid plans: • Payments are processed securely through Stripe • Subscriptions renew automatically unless cancelled • You may cancel at any time from your account settings • Refunds are not provided for partial billing periods • Prices may change with 30 days' notice The Free plan remains available with its stated limitations.
5. Acceptable Use
You agree not to use ZIVR to: • Violate any applicable laws or regulations • Harass, threaten, or harm other individuals • Distribute spam, malware, or unauthorized advertising • Attempt to reverse-engineer, hack, or disrupt the service • Impersonate any person or entity • Collect or harvest user data without consent Violation of these terms may result in immediate account termination.
6. Intellectual Property
All content, features, and functionality of ZIVR — including text, graphics, logos, and software — are owned by ZIVR Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
7. Disclaimer of Warranties
ZIVR is provided "as is" and "as available" without any warranties, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or meet your specific requirements. Sales results using ZIVR depend on many factors beyond our control.
8. Limitation of Liability
To the maximum extent permitted by law, ZIVR Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Modifications
We reserve the right to modify these Terms of Service at any time. We will provide notice of significant changes via email or a prominent in-app notice. Continued use of ZIVR after changes take effect constitutes acceptance of the updated terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
